100% Part Exchange Programme Terms & Conditions

Your Property
  • Marden Homes will offer you 100% of the value of Your Property, based on the average of 2 (two) independent estimates, commissioned by Marden Homes.
  • You will need to provide access to Your Property for the Marden Homes’ nominated agent(s) or our representative(s) within 3 working days’ of notice, for the purposes of valuation and inspection of your property.
  • In the event that a significant (> 3%) discrepancy exists between the 2 (two) estimates obtained, then a 3rd (third) estimate may be sought by Marden Homes and the average taken of the 3 (three) estimates.
  • You agree to cancel any existing arrangements with any agent(s) and any agent fees, commissions, VAT and any other costs remain your sole responsibility. Marden Homes will not accept any liability for any costs, unless otherwise agreed in writing.
  • You undertake to allow Marden Homes to market Your Property, to provide reasonable access for viewings (subject to reasonably agreed appointments) and to erect a “For Sale” sign on Your Property, all prior to your move into your new Marden Home.
  • Prior to exchange of contracts, Your Property must have the following tests and certifications, undertaken at your cost:
    • a Corgi or Gas Safe certification for gas equipment;
    • a PAT or other appropriate form of electrical certification;
    • an Energy Performance Certificate (EPC).
  • Unfortunately we are unable to accept Your Property for Part Exchange if it has a pre-paid meter fitted.
  • A Property Inspection Form (PIF) will be filled out and form part of our legal agreement. The Property Inspection Form (PIF) will specify fixtures and fittings that must remain within Your Property and form part of our offer. The remainder of your belongings in Your Property, including the contents of attics, sheds and garages where applicable, must be removed from Your Property prior to legal completion.
  • In the event that there are specific items you wish to remove from Your Property, you must document these on the Property Inspection Form (PIF) and you would be responsible for the costs to replace them and repair and re-decorate any walls, ceilings or floors affected, to an acceptable standard.
  • You remain responsible for all services to Your Property, up to and including the day of legal completion. You must arrange for final meter readings to be taken such that final bills can be generated and settled by you. Marden Homes accepts no responsibility for any costs prior to the date of legal completion.
  • Your Property must be maintained to an acceptable standard both internally and externally up until legal completion.
Our Property
  • Our 100% Part Exchange offer is made on the basis of you paying 100% of the advertised sale price of Our Property.
  • Part Exchange is only available on selected plots and is subject to our Standard Terms & Conditions.
  • Part Exchange will only be considered where the price of Your Property being traded in is no more than 70% of the advertised sale price of Our Property.
  • Our offer is conditional upon legal completion within 4-6 calendar weeks, unless otherwise agreed in writing.
Our Process Together
  • Following valuation (and inspection where necessary) of Your Property, Marden Homes will issue you with an Offer that you must respond to within 2 (two) working days.
  • Upon acceptance, you have 2 (two) further working days to complete our Reservation Form and pay the Reservation Fee.
  • While Marden Homes will consider any property that meets our criteria, we are under no obligation to make an offer.
  • Our offer is subject to a RICS survey, undertaken at Marden Homes cost. In respect of this, an additional £1,000 Survey Fee will be added to the standard Reservation Fee and credited on legal completion. In the event that either party withdraws from the contract prior to legal completion, the additional £1,000 Survey Fee will be deducted, in addition to any other costs due, from the amount to be refunded.
  • Your purchase of Our Property and our purchase of Your Property and the Part Exchange Agreement are all subject to contract until the exchange has taken place on both properties.
  • Full vacant possession of Your Property will be required upon legal completion.
  • You will not receive the keys and alarm codes to Our Property on the day of legal completion until such time as completion has taken place on Your Property and Marden Homes have confirmation that you have provided the keys and alarm codes to Your Property in accordance with the arrangements made between us prior to legal completion. In the event this does not occur, any costs incurred to change locks or reset alarms on Your Property will be your responsibility and will be recovered by Marden Homes.
  • Any agent(s) appointed by Marden Homes to market and sell Your Property will be acting on behalf of Marden Homes and any fees, commissions and costs agreed will be met by Marden Homes, should the complete transaction proceed to legal completion.
  • In the event that either party withdraws from the transaction, but you later proceed to sell Your Property to any individual introduced by the Marden Homes appointed agent(s) during the period of our instruction, then you would be responsible for the agent’s commission, including VAT.
